For the Record:
On August 28, 1999, during my brief absence at Midtown XXII, a disagreement between CCC members William F. Newton II and acting Assistant Tournament Director Patrick McCartney took place. The first player was "illegally" attempting to communicate his desire to change tables because of the shadows. The second player, citing the rule "not to disturb one's opponent in any way while he is on the move" (his clock is running) refused. The first player persisted and a loud argument ensued during which the second player shouted epithets and vulgar language. Mall patrons, passers-by, employees and managers, maintenance and security personnel were all possible witnesses to this unfortunate event. Upon my return, the incident was not reported to me by the Assistant Director.
The following day, via E-mail, each player had lodged a formal complaint against the other. After further communication between the complaintants and myself, Mr. McCartney offered a formal apology which Mr. Newton readily accepted.
On Wednesday, September 1, 1999, during the CCC meeting, a four man, non-biased committee comprised of Carl McKern, Jerome DeBell, Alphonse Ashamalla and Don Norwood was formed to carefully review all of the evidence in the matter. (This Director abstained from voting). The committee resolved that: "no Charlotte Chess Club member has the right to, nor shall he be subjected to, cursing and abusive language, for any reason."
2. For abusive and vulgar language directed at another CCC member, Patrick McCartney has been issued a formal written reprimand. In addition, a 6 month probationary period shall be enforced, whereby any repeated offense may result in temporary or even permanent expulsion from the CCC.
3. For not properly reporting the incident and not yielding to the duties as Assistant Tournament Director, Patrick McCartney has been relieved of that position, until further notice.
4. For causing a disturbance which may result in the CCC losing it's right to use the Midtown Square facility, the committee has tabled any decision until which time, if any, formal notice of such is received.
I can only hope that in the future, all Charlotte Chess Club members will render equal, friendly respect to each other during the course of tournament competition.
Per Committee's decision,
Leland Fuerstman, Sr. TD
